SOUNDBITE (English) Thomas Shapiro, Attorney:\"So, assuming that we do get court approval, the proposed is that there would be a notice posted at each of the stores advising people that if during a certain period of time, about a year, they'd ordered a bagel with butter in one of these stores, they'd be entitled to a free bagel with butter – up to a maximum of three per customer for how many times they'd ordered a bagel with butter in the past. Defendants said 'we really like a limit on the number of free bagels with butter an individual customer could get because we've agreed not to require documentation.\"8. SOUNDBITE (English) Thomas Shapiro, Attorney:\"Well, there are three firms that have been involved: people who brought the case to me 'coz I'm the specialist in doing class actions so they brought the case to me and they worked on it with me and, you know, if we just added up our hours times our regular time-charge – what we'd charge for an hourly rate in a non-contingent case, it's a lot more than $90,000. The two cases in each defendants would be paying, again, subject to court approval – court has to approve the fees – each defendant would be paying $45,000.
