Currently, the high court is making decisions with eight supreme court justices -- instead of nine -- following the death of Scalia. The Republican-led Senate has so far refused to consider President Barack Obama's nominee to replace Scalia. Yet if presumptive Democratic presidential nominee Hillary Clinton is elected, Sherman says she would likely appoint a justice who would uphold abortion rights.
