Jackson walking with mother Katharine outside courthouse\u003cbr/\u003eMichael Jackson's defence won a legal victory on Thursday as the judge refused a prosecution bid to call an expert on battered women to explain the demeanour of the accuser's mother on the stand.\u003cbr/\u003eDefence attorney Robert Sanger argued vehemently against the expert, saying such testimony was irrelevant.\u003cbr/\u003e\"She has committed perjury in this case from the stand,\" he said of the mother. \"This is not because she's a battered woman. It's because she lies for gain. She lies for gain ... in repeated declarations for money.\"\u003cbr/\u003eThe ruling came as Superior Court Judge Rodney S. Melville dealt with pending motions before taking a long weekend break. Court was scheduled to be in recess Friday.\u003cbr/\u003eJackson is accused of molesting a 13 year-old cancer patient in February or March 2003, giving the boy alcohol and conspiring to hold his family captive to in an attempt to make them to rebut the documentary \"Living With Michael Jackson\" by journalist Martin Bashir. \u003cbr/\u003eJackson said in the programme he let children sleep in his bed but it was non-sexual.\u003cbr/\u003eBefore the court took up the motions, a former guard at Jackson's Neverland ranch testified there could be an error in a visitor log that indicated the family of Jackson's accuser was at the estate on a night prosecutors say they were in Miami.\u003cbr/\u003eThe log indicated the boy and his family stayed at Neverland the night of 6 February 2003, a day when the mother has said they were in Miami, where Jackson prevented them from seeing the documentary in which the accuser appeared with Jackson.\u003cbr/\u003eThe prosecution asked former guard Brian Barron why the log on 7 February 2003, indicated the family had stayed over from the previous night, but the 6 February log did not note their arrival.\u003cbr/\u003e\"Either it was completely overlooked or they weren't there,\" Barron said.\u003cbr/\u003eAsked about a passage on the 6 February log that noted \"owner and guest\" had arrived on that date, Barron said the reference was extremely unusual because Jackson's arrivals and departures were never listed.\u003cbr/\u003e\"For his privacy we never logged him in or out,\" said the witness, a police officer who moonlighted as a Neverland security guard until last year.\u003cbr/\u003eBarron also said he did not recognise the handwriting that noted \"owner and guest.\"\u003cbr/\u003eThe prosecution called Barron to the stand on Wednesday to testify he once saw an order to not allow the boy to leave Neverland. \u003cbr/\u003eBut under defence questioning Barron acknowledged it was general policy that children visiting
