(March 31)\u003cbr/\u003ePope Benedict is under fire again -- this time from an attorney in Miami who says the pope should have defrocked a Miami priest years ago when Benedict headed a Vatican office overseeing church morality -- and the Miami priest, --  Father Ernesto Garcia Rubio -- allegedly sexually abused \u003cbr/\u003ea 15 year old immigrant boy from Nicaragua.\u003cbr/\u003eJessica Arbour -- who represents the alleged victim says her client --who she calls ''John Doe 63'' --  was in the priest''s care when he was molested.\u003cbr/\u003eThe sexual abuse happened in the rectory at Our Lady of Divine Providence Church....and what we know...that while John Doe 63 was living there...with Father Garcia Rubio....who repeatedly told him --you need to be able to do this with me in order to have my protection...if you do this....i will help you get a green card....stay here legally....if you don''t do this...i will have you deported.\"\u003cbr/\u003eArbour showed numerous documents in her lawsuit against the Miami archdiocese.\u003cbr/\u003eShe says in 1994, a year after Rubio got married, he actually petitioned the Vatican himself to be removed from the priesthood, but the Vatican lost the paperwork, and it didn''t do it until years later -- when Rubio had resubmitted his petition.\u003cbr/\u003eMeanwhile -- a church worker in Miami says the allegations of pedophelia against priests in the Catholic  church are taking their toll.\u003cbr/\u003e\"It''s really, you know, painful when a priest falls down or does something that''s not supposed to happen. You know, the Archdiocese has to do something, or the Pope has to do something. But what that something is, that''s hard to say.\" \u003cbr/\u003eThe Archdiocese of Miami is defending its actions and criticizing the alleged victim''s lawyers for making the accusations during Holy
