(April 2) \u003cbr/\u003e(Mark Sherman, Associated Press)\u003cbr/\u003e\"so the court issued a 5-4 decision today. It was split along ideological lines. The courts conservative majority prevailed. And they ruled that a routine strip search of someone who''s being arrested and placed in a general jail population doesn''t violate the man''s constitutional rights. They ruled that the security needs of the jails trump the inmates personal privacy rights.//This case all arose from the arrest of a man named Albert Florence. He was taken to jail in southern, in southern New Jersey at which point he was made to strip and subjected to a visual inspection. And then he was held there a few days and taken to another jail in New Jersey in Newark and was put through the same routine// So the privacy advocates and Mr. Florence himself argued that for people  arrested on minor  offenses, what he was arrested for was not even a crime in New Jersey. It was just a minor offense, that people arrested for minor offenses shouldn''t be subjected to this kind of routine strip search without some suspicion that they might actually be hiding something// Justice Anthony Kennedy who was writing the majority opinion had a different view. He said it doesn''t really matter the circumstances of the arrest. What''s really important is that. He was going to be put in with the jail''s general population and some of the other justices on the court said it might be a different story if the man was to have been kept apart from the general population maybe and they didn''t decide this today. But, maybe that would not justify the kind of routine strip search// So, in some states it''s against the law to do routine strip searches and in other states it''s not. So, this doesn''t require a strip searches, by any means. But it does say that if that''s your policy, that absent any other problems there''s not a reason, there''s no reason for the courts to question
