Medium shot Larry Birkhead leaving \u003cbr/\u003eLawyers acting on behalf of Anna Nicole Smiths former boyfriend -photographer Larry Birkhead on Thursday, filed a second lawsuit in the Bahamas against the TV star alleging fraud and conspiracy, Birkhead's lawyer Debra Opri confirmed.\u003cbr/\u003e\"My client, Mr Birkhead, has now instructed my office to secure Bahamian counsel to file an immediate action for fraud and conspiracy based upon Anna Nicole Smith's and Howard K. Stern's having filed fraudulent documents with the Bahamian government,\" Opri said.\u003cbr/\u003eSmith has been in the Bahamas since the birth of her daughter Dannielynn Hope Marshall Stern, now just 6 weeks old.\u003cbr/\u003eBirkhead had previously filed a paternity suit in California, claiming he is the father of the baby girl - the hearing for that case has \u003cbr/\u003enow been delayed until next week.\u003cbr/\u003eThe new law suit alleges Smith provided fraudulent information when applying for her daughter's birth certificate in the Bahamas. \u003cbr/\u003eSmith identified her lawyer, Howard K. Stern, as the father. \u003cbr/\u003eBirkheads lawsuit requests that Stern's name be deleted from the girl's birth certificate and replaced with 'Birkhea.d'\u003cbr/\u003eSpeaking from outside court Opri said  \"It will be up to this government entity to pursue any criminal  investigation against either Anna Nicole Smith and or Howard K.Stern.\" \u003cbr/\u003eOpri said Birkhead has retained a law firm in Nassau to handle the new lawsuit. \u003cbr/\u003eOpri spoke directly to Smith and Stern in a televised statement, warning the pair have just 14 days to respond.\u003cbr/\u003e\"Anna; I'm speaking to you and I want you to hear me, I want you to listen to what I'm going to tell you: service of this complaint, which was filed a few hours ago, is now underway, if you have not already been served. Thompson, a developer from Myrtle Beach, S.C., has said he still owns the house where the 38-year-old Smith moved while\u003cbr/\u003epregnant. \u003cbr/\u003eSmith's lawyers have said she moved to the island nation seeking privacy during her pregnancy.\u003cbr/\u003eSmith's daughter was born Sept. 7. \u003cbr/\u003eThree days later after her daughters birth Smith's 20-year-old son, Daniel, died while visiting her in a Nassau hospital. \u003cbr/\u003eThe results of official toxicology tests and a police investigation into his death have not been publicly
