Jurors who convicted Nichols on Tuesday of eight counts of...\u003c/span\u003e\n\u003cspan class='full-description hide'\u003eEnglish/Nat\u003cbr/\u003eProsecutors in the trial of Terry Nichols won the go-ahead from the judge on Wednesday for the jury to consider the death penalty as a possible punishment.  \u003cbr/\u003eJurors who convicted Nichols on Tuesday of eight counts of involuntary manslaughter and conspiring to blow up the Oklahoma City federal now have the task of deciding Nichol's fate.\u003cbr/\u003eA federal judge rejected defence arguments that Nichols shouldn't face death because jurors decided he didn't set out to murder anyone under the involuntary manslaughter conviction.\u003cbr/\u003eThe emotional journey for the families who lost loved ones in the Oklahoma City bomb attack was almost over in Denver on Wednesday. \u003cbr/\u003eThey left the courthouse where the judge refused to eliminate the option of the death penalty for the jury which is deciding how to punish Terry Nichols.\u003cbr/\u003eHe was found guilty of conspiracy and involuntary manslaughter on Tuesday for his part in the April 1995 bombing that killed 168 people.\u003cbr/\u003eU-S District Judge Richard Matsch also refused a request to block emotional testimony from victims when the sentencing phase of Nichols' trial begins on Monday. \u003cbr/\u003eThat decision won applause from Jannie Coverdale - who lost two grandchildren in the Oklahoma blast and who has been critical of the jury's verdict.\u003cbr/\u003eSOUNDBITE: (English)\u003cbr/\u003e\"Maybe Terry Nichols was a junior partner, but he could have made one phone call and said 'hey there is somebody over on their way to Oklahoma City driving a Ryder truck that has got a four thousand (word unclear) bomb on it and you need to be aware of this and he would still have been in Kansas. Terry Nichols knew what was going to happen and he kept his mouth closed so even though he wasn't in Oklahoma City, to me he is just as guilty as Timothy McVeigh.\"\u003cbr/\u003eSUPER CAPTION: Jannie Coverdale, Grandmother who lost two grandsons in the bombing\u003cbr/\u003eProsecutor Sean Connelly said there is no doubt that the bombing was an act of violence with a wanton disregard for life and that the death penalty would be appropriate.\u003cbr/\u003eHe said the government will rely on federal laws that allow the death penalty if the defendant knew lethal force would be used, even if he didn't take part in the act.\u003cbr/\u003eIn arguing that Nichols should be spared the death penalty, defence attorney Michael Tigar said there could not be a death sentence without proof of major participation.\u003cbr/\u003eTigar argued since the jury acquitted the defendant of all forms of intentional homicide, the government cannot now ask the same jury to rule that Nichols intended to kill the victims in order to impose the death penalty.\u003cbr/\u003eThe jury convicted Nichols of conspiracy and involuntary manslaughter in the bombing on Tuesday, but found him innocent of murder and using a truck bomb to kill people and destroy the building.\u003cbr/\u003eLegal analyst Andrew Cohen described the verdict as a compromise.\u003cbr/\u003eSOUNDBITE: (English)\u003cbr/\u003e\"This is an interesting verdict. It means that the jury thought that Terry Nichols had something to do with it, but they weren't quite ready to pin a first degree murder charge on him. It means that there's a chance that Terry Nichols could be in prison for life or even less. It means that Terry Nichols can get out of prison at some point based on the crime he's now been convicted of.
