D. says the regulation will take effect when the state officially acknowledges  flu season has begun.\u003cbr/\u003e\" New York state within the next month will issue a requirement by regulation from the health department that every health care worker in the state in hospitals, in nursing homes, hospice programs, home care programs must get a flu vaccine or they will have to were a mask,\" Caplan says\u003cbr/\u003eThe New York Health Department rule applies to more than 4,000 hospitals, clinics, diagnostic centers, nursing homes, hospices and home care agencies statewide. \u003cbr/\u003eAnd it specifically applies beyond doctors and nurses to students, volunteers, contractors and even some cafeteria workers.\u003cbr/\u003e\" We need to have it so that there is no chance for us to infect our patients with the flu and vice versa,\" admits Danielle Chevalier, a nurse at NYU's Langone Medical Center.  \u003cbr/\u003eHealth facilities are required to document their employee compliance and vaccination status during the flu season, which ran from late November to April last year. \u003cbr/\u003eThe rules carry no immediate penalties or sanctions and do not apply to hospital visitors.\u003cbr/\u003eBut some, like William Javier, a CAT Scan Technologist  at NYU's Langone Medical Center, feels \" that if you take care of your body it will take of itself if it does get sick.\"\u003cbr/\u003eJavier, who works at several health care facilities,  says he is getting a flu shot because he doesn't want to wear a mask.\u003cbr/\u003eNew York recorded 45,352 confirmed cases and 9,537 patients hospitalized with influenza last season, when the flu was considered widespread for 22 weeks and cited in 14 pediatric deaths. \u003cbr/\u003eAfter a spike in flu cases in January, Gov. Andrew Cuomo declared a public health emergency.\u003cbr/\u003eThe flu vaccine takes about two weeks to establish virus-resistant antibodies. \u003cbr/\u003eThe vaccine typically contains three common strains of flu virus. \u003cbr/\u003eFederal health officials said last year's vaccine was about 62 percent effective at preventing infections.\u003cbr/\u003eCaplan says there was initial push back from those who opposed government requiring medical treatment like a flu shot.\u003cbr/\u003e\" In trying to figure out how best to approach that resistance by adding the option of wearing a mask it took a lot of the steam out of those who didn't want to get a shot,\" Caplan admits. \u003cbr/\u003eSeventeen other states have regulations, mostly requiring hospitals provide flu shots free to staff and some requiring immunizations or else individual exemptions because of health concerns or religious beliefs, according to the U.S. Centers for Disease Control. \u003cbr/\u003eThe CDC says the shots are safe, have not been shown to harm pregnant women or their babies, and do not raise the risk of Guillain-Barre syndrome, a rare immune system disorder that can damage nerves. \u003cbr/\u003eA study showed that the 1976 swine flu vaccine resulted in a small increased risk for the syndrome.\u003cbr/\u003eThe agency collects reports on adverse vaccine reactions, showing 457 serious incidents out of 122 million doses distributed last season, including 31 cases of severe allergic reactions or seizures in those suspected of having egg allergies and 72 of Guillain-Barre.\u003cbr/\u003eSeveral unions representing health care workers opposed New York's regulation, calling the requirement coercive. \u003cbr/\u003eWhile recommending its members get vaccinated for their protection, the New York State Nurses Association said \"the prudent strategy\" is to provide for paid sick time so sick personnel can stay home while they're infectious.\u003cbr/\u003eNew York, New York - October 25, 2013\u003cbr/\u003e1.
