SOUNDBITE (English) Shi Jiuyong, presiding judge, International Court of Justice:\u003cbr/\u003e\"By its order of the 5th of February 2003, the court, acting on a request by Mexico, indicated by way of provisional measure, the United States of America, should take all measures necessary to ensure that Mr.C�sar Roberto Fierro Reyna, Mr. Roberto Moreno Ramos and Mr. Osvaldo Torres Aguilera are not executed pending final judgement in these proceedings. The order of 5th February 2003 according to its terms and to article 41 of the statute was effective in final judgement. And the obligations of the United States in that respect are, with effect from the date of the present judgement replaced, by those declared in this judgement. The court has rejected Mexico's submission that by way of \"restitutio in integrum\" (partial or total annulment of conviction and sentence) the United States is obliged to narrow the convictions and the sentences of all of the Mexican nationals that are the subject of these claims. The court has found that in relation to these three persons among others, the United States has committed a breach of its obligations under article 31 paragraph 1 (b) of the Vienna Convention and article 36 paragraph 1(a) and (c) of that convention. Moreover, in respect of those three persons alone the United States has also committed a breach article 36 paragraph 2 of the said convention. The review and reconsideration of conviction and sentence required by article 36 paragraph 2 which is the appropriate remedy for breeches of article 36, paragraph 1 has not been carried out. What we heard earlier in the court was an abbreviated opinion that was given by the court and in conjunction with our Justice Department, we will study it. But clearly there were finding that ruled against a number of the Mexican submissions, they found favourably on our compliance programme and in due time we will be studying this back in the United States and have more comments.\"\u003cbr/\u003e16. Court corridor\u003cbr/\u003eThe International Court of Justice has ruled that the United States violated the rights of 51 Mexicans on death row and ordered their cases be reviewed.\u003cbr/\u003eThe United Nations' highest judiciary, also known as the world court, was considering whether 52 convicted murderers had received their right to assistance from their government in a case filed by Mexico.\u003cbr/\u003eOn Wednesday in The Hague, presiding judge Shi Jiuyong said the US should review the conviction and sentence of the Mexicans.\u003cbr/\u003eShi Jiuyong said the court had found the United States violated its obligations in all but five cases in Mexico's case. He said the review, in almost all cases, could be carried out under the normal appeals process in the United States.\u003cbr/\u003eAt the heart of the Mexico-US case is the 1963 Vienna Convention, which guarantees people accused of a serious crime while in a foreign country the right to contact their own government for help and that they be informed of that right by arresting authorities.\u003cbr/\u003eThe United States is portraying the case as a sovereignty issue and says the 15-judge tribunal should be wary of allowing itself to be used as a criminal appeals court, which is not its mandate.\u003cbr/\u003eIn hearings in December, lawyers for Mexico argued that any US citizen accused of a serious crime abroad would want the same right, and the only fair solution for the 52 men allegedly denied diplomatic help was to start their legal processes all over again.\u003cbr/\u003eMexico has said it wants to make sure its citizens aren't abused by a foreign legal system they don't always understand.\u003cbr/\u003eUS lawyer William Taft argued that the prisoners had received fair trials. \u003cbr/\u003eHe said even if the prisoners didn't get consular help, the way to remedy the wrong \"must be left to the United States\".\u003cbr/\u003eIn its written arguments, the United States said that Mexico's request would be a \"radical intrusion\" into the US justice system, contradicting laws and customs in every city and state in the nation.\u003cbr/\u003eUnder the court's statute, its judgments are \"binding, final and without appeal\". Its rulings have only rarely been ignored, and if one side claims the other has failed to carry out the court's decision, it may take the issue to the UN Security Council.\u003cbr/\u003eIn the current case, the court ordered the United States to halt the execution process of three Mexicans, two in Texas and one in Oklahoma, until the ruling.\u003cbr/\u003eThe prisoners are still alive. \u003cbr/\u003eThe first of the men, Osvaldo Torres, is scheduled to be executed in Oklahoma in May.\u003cbr/\u003eThe death penalty is opposed by most developed countries, but the issue has been a special source of irritation to Mexico. The Death Penalty Information Center says 55 of the 121 foreigners on US death row are Mexican.\u003cbr/\u003eMexican President Vicente Fox cancelled a visit to US President George W Bush's ranch in 2002 to protest the execution of a Mexican citizen not mentioned in the world court suit.
