File of Lai interviewed by police\u003cbr/\u003eA Canadian judge upheld a decision on Tuesday denying refugee status in Canada to China's most wanted fugitive, Lai Changxing.\u003cbr/\u003eLai said he would appeal the ruling issued by Justice Andrew MacKay.\u003cbr/\u003eChinese authorities have accused Lai of being the mastermind behind a smuggling ring based in Xiamen, China, that fed as much as 10 (b) billion US dollars worth of goods into the country under the protection of corrupt officials.\u003cbr/\u003eThe ruling followed MacKay's review of a 2002 Canadian refugee board decision that denied Lai refugee status in Canada. \u003cbr/\u003eThe decision also applied to Lai's wife Tsang Mingna and their three children.\u003cbr/\u003eMacKay's review was to determine whether the refugee panel made reasonable findings, not to decide Lai's guilt or innocence.\u003cbr/\u003eThe judge found the panel's determination denying the Lai family refugee status \"was reasonably supportable on the basis of the evidence before the panel.\"\u003cbr/\u003eMacKay added that \"there is no basis to intervene in relation to the panel's conclusions that the crimes alleged in this case, smuggling and bribery, were non-political crimes.\"\u003cbr/\u003eLai said little at a news conference on Tuesday other than to say he would continue to fight being sent back to China.\u003cbr/\u003eLai's lawyer, David Matas, said his client was concerned he would be sentenced to death like others in the case if he was returned to China, despite assurances from Chinese authorities that he would not be executed.\u003cbr/\u003eMatas also said the Canadian government appeared determined to extradite Lai to protect trade relations. \u003cbr/\u003eAndrew Wlodyka an immigration lawyer, spent many years on the immigration and refugee board. His outlook on the Lai case is a little different. He said Lai was a wanted fugitive, \"pure and simple\".\u003cbr/\u003eFurther appeals could be heard by the Federal Court of Appeal and the federal Immigration Department in a \"risk of return\" review. Matas has said previously the case could eventually end up in the Supreme Court of Canada.\u003cbr/\u003eChina has executed eight people connected to the case and 18 more face the death penalty.\u003cbr/\u003eMacKay's ruling said \"there was no evidence that would support conclusions that the applicants would face torture or degrading treatment upon their return to China.\"\u003cbr/\u003eChina claims the smuggled goods brought in by Lai's ring included cigarettes, vehicles, heating and cooking oil, textiles, chemicals and other raw materials.\u003cbr/\u003eLai arrived in Canada with his wife Tsang Mingna and three children in August 1999 after fleeing China by way of Hong Kong. \u003cbr/\u003eFearing persecution or worse if they were returned to China, they applied for refugee status.\u003cbr/\u003eDetention review hearings and a five-month-long refugee hearing followed in 2002, drawing international attention with allegations of bribery and multi-billion dollar tax and duty evasion.\u003cbr/\u003eThe refugee board panel found Lai and Tsang were \"not credible and that there were serious reasons for considering Lai had committed the crimes of smuggling and bribery.\"\u003cbr/\u003eMacKay's decision had been expected in September, but the judge requested more time.\u003cbr/\u003eLai has been under house arrest for the past three
