oil-rich Equatorial Guinea challenged on Tuesday the legality of a South African government subpoena to question him about the case.\u003cbr/\u003eThatcher, who is the son of former British prime minister Margaret Thatcher, has lived in South African since 1995. \u003cbr/\u003eHe was subpoenaed after the South African government granted an Equatorial Guinea request to question him about the allegations. \u003cbr/\u003eThatcher's lawyers argued, however, that it was unconstitutional to subpoena him to respond to those questions while he has related South African  charges pending. \u003cbr/\u003eEquatorial Guinea wants to question a number of prominent Britons, including Thatcher, who was arrested on August 25, about allegations they financed a plot earlier this year to overthrow President Teodoro Obiang Nguema.\u003cbr/\u003eNguema has ruled Africa's third-largest oil producer for the past 25 years.\u003cbr/\u003eNineteen people are on trial in Equatorial Guinea, including Nick Du Toit, a South African arms dealer alleged to have led an advance team for the plot.\u003cbr/\u003eDu Toit, the only suspect facing the death penalty, has testified that he met with Thatcher and others repeatedly in the months before the alleged coup attempt. \u003cbr/\u003eThatcher's defence lawyer Peter Hodes alleged that Equatorial Guinea's legal system was flawed.\u003cbr/\u003eHe criticised the South African government for not acknowledging this and for allowing the request for questioning, which he said could be used in an unfair trial against Du Toit and possibly later against Thatcher. \u003cbr/\u003eThatcher faces trial on November 25 in South Africa on charges of violating the Foreign Military Assistance Act by financing an illegal military action in a foreign country.  \u003cbr/\u003eHe denies the charges and has said he will cooperate with authorities. \u003cbr/\u003eFollowing Tuesday's hearing, Thatcher left the High Court looking relaxed.  \u003cbr/\u003eBut he told waiting journalists that he could not comment at this stage and pre-empt the judges decision on the case. \u003cbr/\u003eThe hearing continues on Wednesday.
