Various onscreen views of Napster web site\u003cbr/\u003eEnglish/Nat \u003cbr/\u003eOral arguments before a panel of federal judges began on Monday over the recording industry's copyright infringement case against Napster. \u003cbr/\u003eComputer users who access the Napster internet web site on the world wide web can download music from each other that is stored in the format known as an M-P-3 file.\u003cbr/\u003eIn July a federal judge had issued an injunction against Napster, saying it was encouraging \"wholesale infringing\" against music industry copyrights. \u003cbr/\u003eBut hours before Napster's computer servers were to be shut down, the ninth U-S Circuit Court of Appeals stayed the injunction, keeping the company's service alive - at least for now.\u003cbr/\u003eLawyers for Redwood City-based Napster are trying to persuade a three-judge panel to keep the stay in place, pending a trial of the Recording Industry Association of America's lawsuit against Napster.\u003cbr/\u003eNapster lawyer David Boies told the panel on Monday that the lower court's injunction was \"unprecedented\" against a company \"supplying the technology that is capable of a non infringing use.\"\u003cbr/\u003eA lawyer for the recording industry says Napster's system of downloading music is contributing to copyright infringement by allowing people to swap pirated music.\u003cbr/\u003eAttorney Russell Frackman says Napster should be held liable just as one who runs a swap meet is liable for pirated music that gets sold there. \u003cbr/\u003eBut he also says the industry is not trying to punish the consumer for using Napster.\u003cbr/\u003eBoth sides in the case say they are fighting for their survival. \u003cbr/\u003eThe three-judge panel has already expressed concerns about the injunction to halt Napster and will try to determine whether it was overly broad.\u003cbr/\u003eNapster, started in a Northeastern University dormitory room last year, pioneered the concept known as peer-to-peer computing, in which people share files from their own computers rather than a central server. \u003cbr/\u003eSOUNDBITE: (English)\u003cbr/\u003e\"First amendment enjoins the distribution of copyright material all the time but this directory service is not copyrighted or if it is copyrighted it's copyrighted by Napster so what is being done here on the basis of what we think is a very overbroad prior restraint is to forbid and in a way in which no appellate board has ever done before a distribution of intellectual information, intellectual knowledge owned by and created by the person that's distributed it. \"\u003cbr/\u003eSUPER CAPTION: David Boies, Attorney for Napster\u003cbr/\u003eSOUNDBITE: (English)\u003cbr/\u003e\"The important intended objective of this standard is to exclude sophisticated pirate directories which refer internet users to other selected internet sites where pirate software, books, movies and music can be downloaded or transmitted from the safe harbour exactly at least by analogy to what Napster is doing here.
