Madonna walking to car surrounded by reporters \u003cbr/\u003eMalawian rights organisations say their government needs help monitoring Madonna's planned adoption of a Malawian boy, and a child welfare official agrees that the southern African country's foreign adoption procedures need to be overhauled.\u003cbr/\u003eMadonna and her husband, film director Guy Ritchie, took custody of David Banda, then 14 months old, last October.\u003cbr/\u003eMalawian child welfare officials granted them initial custody of the boy, whose father, who is still living, had placed him in the orphanage where Madonna found him after the mother died following his birth. \u003cbr/\u003eCritics have argued Madonna, who met David while in Malawi to launch a project to help the country's two (m) million AIDS orphans, of using her celebrity status to circumvent Malawian adoption laws; allegations she denies.\u003cbr/\u003eOne of the problems is that Malawian law is ambiguous on foreign adoptions. \u003cbr/\u003eRegulations only stipulate that prospective parents undergo an 18-to-24 month assessment period in Malawi, a rule bent when Madonna was allowed to take David to London.\u003cbr/\u003eInternational adoption and children's rights groups have said the lack of clarity in Malawi's law could make its children vulnerable to trafficking.\u003cbr/\u003eIn Malawi, a coalition of 67 children's and human rights organisations raised the lack of regulations in their successful legal suit to become party to the process of overseeing David's adoption.\u003cbr/\u003eThe chairman of the coalition of rights groups, Justin Dzonzi said the group recently had gone to court again, this time asking that regulations be put in place for both Madonna's adoption of David and foreign adoptions in general. \u003cbr/\u003eThe group suggests Malawi adopt a UN convention on international adoptions, under which authorities in the prospective parents' home country could monitor the child's and family's progress. \u003cbr/\u003eAssessments would then be communicated to the country from where the child came.\u003cbr/\u003eThe coalition of rights groups has reservations also about whether the Malawian official chosen to assess David's environment in the UK was competent enough.\u003cbr/\u003ePenston Kilembe, the director of Malawi's Child Welfare Services, is personally overseeing the Madonna case and indicated in an interview this week that he agreed that Malawian adoption law needed changes.\u003cbr/\u003e\"We are using an archaic law, a law which has been there for too long, and we are thinking like you, we need to review it so that it meets prevailing conditions now,\" he said.\u003cbr/\u003eHowever, he played down questions about whether he could assess the Madonna adoption, saying his job was straightforward.\u003cbr/\u003e\"What we expect is the child must be provided all the necessities of basic needs for him to grow up. He must go to school, must socialise, he must be taken care of,\" Kilembe said.\u003cbr/\u003eA child must have a \"comprehensive medical cover so that he is able to be protected,\" he added. \u003cbr/\u003eBut already, Malawi's Child Welfare Services office has missed one planned visit to London to check on how David Banda is doing with his celebrity family. \u003cbr/\u003eKilembe, indicated that money was one of the reasons the trip, which was originally scheduled in May, had been postponed. \u003cbr/\u003eHe said he now hoped to go by the end of August.\u003cbr/\u003e\"We have been unable to travel because of logistical problems,\" Kilembe said. \u003cbr/\u003e\"You know it requires some resources for me to travel,\" he added.\u003cbr/\u003eThe welfare officials were expected to file a report on the suitability of Madonna and Ritchie as adoptive parents after two trips to their London residence. \u003cbr/\u003eOriginally, the trips were planned for May and December.\u003cbr/\u003eDzonzi remains convinced that it was unrealistic to expect Malawi to oversee the adoption without help, possibly from British child welfare authorities.\u003cbr/\u003eBut in an interview with AP Television recently, Stevan Whitehead, chairman of the Overseas Adoption Support and Information Service, a private British group, seemed to support an assessment by a Malawian official.\u003cbr/\u003e\"It makes perfect sense to me that a social worker or a specialist from Malawi is the person who comes to do the assessment,\" he said\u003cbr/\u003eAdding that he assumed Madonna had made arrangements with the Malawian government to have the necessary assessments carried out wherever she happened to be, rather than in Malawi.\u003cbr/\u003e\"That has happened on a
