She later failed to win her freedom despite an acknowledgement from the judge that she was being held under the wrong law. \u003cbr/\u003e43 year old Brenda Denise Ferguson of Milwaukee, Wisconsin, could hang if she's found guilty of drug trafficking.\u003cbr/\u003eShe was arrested by custom officials on Monday, after she checked in for a flight for Singapore.\u003cbr/\u003eShe had gone through all security checks and boarded the aircraft\u003cbr/\u003ewhen custom officials boarded following a tip-off.\u003cbr/\u003eCustoms officials allege they found 2.2 kilograms (4.85 pounds) of a white substance, believed to be heroin, in a compartment of her bag.\u003cbr/\u003eUnder Malaysian law, anyone possessing more than 15 grams (0.529 ounces) of heroin is regarded as a trafficker, and a conviction carries a mandatory death sentence. \u003cbr/\u003eHer case is before the Shah Alam High Court, just five miles south of the Kuala Lumpur International Airport where she was taken into custody.\u003cbr/\u003eOn Friday, Ferguson's local lawyer argued in the court that she has been detained under the wrong criminal laws and should be released or re-arrested.\u003cbr/\u003eHe argued that she was arrested under one law but then detained under another.\u003cbr/\u003eJudge James Foong agreed that a legal error had been made, but said it was not enough to alter the detention order.\u003cbr/\u003eSince the Malaysian parliament enacted laws in 1975 requiring the execution of convicted traffickers, 525 people have been sentenced to death and about 210 have been executed.\u003cbr/\u003eThe others are awaiting appeals or dates for hanging.\u003cbr/\u003eMalaysia September 8 1995\u003cbr/\u003e1.
