There is good reason for it - because if we are going to include water-boarding what are we going to do about the other techniques that Senator Durbin mentioned: the mock executions, or forced nudity. Wide shot of hearing\u003cbr/\u003eThe Judiciary Committee advanced United States Attorney General designate Michael Mukasey's nomination to the Senate floor on Tuesday, virtually ensuring confirmation for a former judge embroiled in bitter controversy over prisoner interrogations.\u003cbr/\u003eThe 11-8 vote came only after two key Democrats accepted his assurance to enforce any law Congress might enact against so-called water-boarding, a simulated drowning interrogation technique.\u003cbr/\u003eA short time later, White House spokeswoman Dana Perino welcomed the news saying \"Judge Mukasey has clearly demonstrated that he will be an exceptional Attorney General at this critical time.\"\u003cbr/\u003eThough Mukasey is expected to easily win confirmation by the full Senate, Democrats and some Republicans were far from satisfied with his answers on torture, presidential signing statements and executive power. \u003cbr/\u003eDemocratic Senator Dianne Feinstein said her vote for Mukasey's confirmation came down in part to practicality. \u003cbr/\u003eIf Mukasey's nomination were killed she claimed that President George W. Bush would install an acting attorney general not subject to Senate confirmation and make recess appointments to fill nearly a dozen other empty jobs at the top of Justice.\u003cbr/\u003eBush, Feinstein added, \"appointed this man because he believes he is mainstream.\"\u003cbr/\u003eMany Democrats came out in opposition to Mukasey after he refused to say unequivocally that water-boarding is tantamount to torture and thus illegal under domestic and international law.\u003cbr/\u003eMukasey rankled Democrats during his confirmation hearing by saying he was not familiar with the water-boarding technique and could not say whether it was torture.\u003cbr/\u003eCommittee Chairman Patrick Leahy voted against Mukasey.\u003cbr/\u003e\"Just as I do not support this President's Iraq policy,  I do not support his torture policy or his views on accountability or unlimited executive power,\" Leahy said.\u003cbr/\u003e\"What we need most right now is an Attorney General who believes and understand that there have to be limitations on executive power,\" he added.\u003cbr/\u003eRepublican Senator Arlen Specter suggested that Mukasey declined to call water-boarding illegal torture because he wanted to avoid putting at legal risk US officials who may have engaged in the practice.\u003cbr/\u003eSpecter said that outlawing water-boarding rests with Congress. \u003cbr/\u003eHe revealed that he had talked with Mukasey a day earlier and received an assurance that the nominee would back up any such legislation and quit if Bush ignores his opinion.\u003cbr/\u003eThus, Specter said, Mukasey had won his support.\u003cbr/\u003eIn response, Maryland Democrat Ben Cardin, mocked the notion that the issue of water-boarding needed to come back to the Senate for further legislation, saying it was already illegal.\u003cbr/\u003eSenator Cardin said not only is it \"not easy to pass a statute in this Senate,\" he asked where would the line be drawn.\u003cbr/\u003e\"If we are going to include water-boarding what are we going to do about the other techniques that Senator Durbin mentioned: the mock executions, or forced nudity.
