(Oct. 13)\u003cbr/\u003eBoth Pentagon and Department of Justice officials are now reviewing the latest blow to the policy, \"don't ask, don't tell\" -- which bans openly gay troops from serving in the military.\u003cbr/\u003e  Tuesday, a federal judge ordered the military to immediately stop enforcing the 17-year-old policy.\u003cbr/\u003eSOT: I was ecstatic. I think everytime we have a judge who finds what we've found for 17 years that this law is unconstitutional is a great victory\u003cbr/\u003e  Justice Department attorneys have 60 days to appeal the injunction -- but its unclear if they will.\u003cbr/\u003e  Currently President Barack Obama is backing a Democratic effort to repeal the law.\u003cbr/\u003e  So, it appears this latest ruling leaves the administration with two choices ... Either defend a law it opposes or do nothing and let the policy be overturned.\u003cbr/\u003eSOT: don't ask don't tell is here for years. The appelate process will take time @ 4:46\u003cbr/\u003e  For former military members who have been kicked out of the armed services because of the ban say they take this latest ruling with guarded optimism.\u003cbr/\u003eSOT:  i've been in this war long enough to know not to celebrate one battle victory , I recognize its not over. We know there is more work to do. We still have to go to Congress. Until Congress repeals it - we still haven't completed our job\u003cbr/\u003e  Zoe Dunning was one of the first tried under the 'don't ask, don't tell' policy. She is one of more than 13 thousand service men and women estimated to have been fired since the Clinton-administration era policy was enacted.\u003cbr/\u003eSOT: When its repealed you won't see some mass coming out. People just don't want to fear for their job any longer.\u003cbr/\u003e  Defense Secretary Robert Gates and Chairman of the Joint Chiefs of Staff Mike Mullen have both said they support lifting the ban. However, both prefer to move more slowly.
