Wide shot of Supreme Court\u003cbr/\u003eFor the third time since the creation of an off-shore detainee camp at Guantanamo Bay, the US Supreme Court this week will examine the rights of its detainees.\u003cbr/\u003eIn a closely watched case, the justices will consider whether about 300 other prisoners at Guantanamo can go to courts on the US mainland to challenge their confinement. \u003cbr/\u003eJust three detainees are facing charges at the moment, although Pentagon officials have talked about eventually holding military trials for 60 to 80 prisoners.\u003cbr/\u003eThe case turns on the reach of the writ of habeas corpus, a centuries-old legal principle which allows courts to determine whether a prisoner is being held illegally.\u003cbr/\u003eThe appeals of Algerian Lakhdar Boumediene, who was arrested in Bosnia in 2001, and Kuwaiti Khaled al-Odah, seized in Pakistan in 2002, could threaten the military commissions created to try those detainees which the Bush administration believes are a threat to national security.\u003cbr/\u003eWashington attorney Tom Wilner, who is representing the Kuwaiti detainees believes the case which is crucial to his clients, settles a vital matter of US law as well. \u003cbr/\u003e\"The key issue before the Supreme Court is whether the United States government can take foreigners and hold them outside of the United States administration.\u003cbr/\u003eEach time the US Congress and The White House have changed the law in an effort to keep the Guantanamo prisoners from contesting their detention before American judges.\u003cbr/\u003eThe indefinite detentions have become a focal point of international criticism of the administration's \"War on Terror\", with increasing calls for closing the Guantanamo facility.\u003cbr/\u003eGeorgetown Law Professor Neal Katyal, who argued the first case before the Supreme Court believes the Bush administration will be unsuccessful in its attempt to prevent detainees from seeking redress in the civilian courts. \u003cbr/\u003e\"I, like I think most legal observers, believe that the government will have a very tough time defending the constitutionality of a law that divests the Supreme Court of the ability to hear these cases,\" he said.\u003cbr/\u003eThe administration is mounting a vigorous defence of its detention policies.\u003cbr/\u003eIn a court filing, the administration's top Supreme Court lawyer says the cells at Guantanamo hold people suspected of plotting terrorist attacks or with ties to the al-Qaida network and the Taliban who formerly ruled Afghanistan. \u003cbr/\u003eSolicitor General Paul Clement says the detainees enjoy more procedural protections than any other captured enemy combatants in the history of warfare.\u003cbr/\u003eDespite the prisoners' six years of confinement, Clement says the justices should not upset the detainees' classification as enemy combatants \"at this preliminary stage,\" even if the court rules that the detainees can be heard in U.S. courts.\u003cbr/\u003eThe government says foreigners held outside the United States have no constitutional rights and that Congress has stripped federal courts of jurisdiction in the detainee cases.\u003cbr/\u003eThe case has attracted 26 court filings on behalf of the detainees. \u003cbr/\u003eAmong those weighing in are Canadian and European lawmakers, former US judges, diplomats and military officers, Israeli law professors, human rights organisations, liberal interest groups, the libertarian Cato Institute and Republican Senator Arlen Specter.\u003cbr/\u003eFour legal briefs, from retired military officers, national security organisations and conservative public interest law firms, are supporting the administration.\u003cbr/\u003eIn an unusual step, the Supreme Court has ruled it will issue audio recordings of opening arguments shortly after they are
