tactic has saved American lives and could be used in the future.\u003cbr/\u003eHayden told the US House of Representatives Intelligence Committee that he officially prohibited CIA operatives from using waterboarding in 2006 in the aftermath of a US Supreme Court decision and new laws on the treatment of US detainees.\u003cbr/\u003eHe said the agency has not used waterboarding for \"just a few weeks short\" of five years. \u003cbr/\u003eHe officially prohibited it from CIA interrogations in 2006.\u003cbr/\u003e\"It is not included in the current programme and my own view, the view of the lawyers and the Department of Justice, it is not certain that that technique would be considered lawful under current statute,\" Hayden said. \u003cbr/\u003eThough now legally questionable, Hayden said waterboarding was legal in 2002 and 2003, a time period when the technique was used to interrogate al-Qaida detainees.\u003cbr/\u003eHayden's comments came just hours after Attorney General Michael Mukasey, in a separate House hearing, said the Justice Department would not investigate whether US interrogators broke the law when waterboarding accused terrorists after the September 11, 2001, attacks on the United States.\u003cbr/\u003eJudiciary Committee Chairman, Democrat Representative John Conyers, asked Mukasey: \"Are you ready to start a criminal investigation into whether this confirmed use of waterboarding by US agents was illegal?\"\u003cbr/\u003eMukasey answered bluntly, \"no, I am not.\"\u003cbr/\u003e\"Whatever was done as part of a CIA program when it was done, was the subject of a Department of Justice opinion, through Office of Legal Counsel, that was found to be permissible under the law as it existed then,\" Mukasey said.\u003cbr/\u003eHe said the Justice Department could not investigate or prosecute people for actions that it had earlier authorised.\u003cbr/\u003eWaterboarding involves strapping a person down and pouring water over his or her cloth-covered face to create the sensation of drowning. \u003cbr/\u003eCritics say waterboarding violates the UN Convention Against Torture and US laws outlining legal treatment of detainees.\u003cbr/\u003eThe panel's top Republican, Representatives Lamar Smith, said he hopes \"the administration will not be defensive about using some admittedly harsh but non lethal
