Einhorn has been fighting U-S efforts to get him extradited back to Pennsylvania by trying to persuade the judge of his innocence even though a U-S...\u003c/span\u003e\n\u003cspan class='full-description hide'\u003eEng/French/Nat\u003cbr/\u003eThe American fugitive Ira Einhorn has again denied killing his girlfriend. \u003cbr/\u003eEinhorn has been fighting U-S efforts to get him extradited back to Pennsylvania by trying to persuade the judge of his innocence even though a U-S court has found him guilty.\u003cbr/\u003eA prominent anti-war campaigner and activist in the 1960s, Einhorn, fled the United States shortly before his trial in 1980.\u003cbr/\u003eThe victim's family arrived at the courtroom hoping to see the man that allegedly killed their sister extradited to the United States.\u003cbr/\u003eBut the judge deferred a decision on the extradition request - the second by the United States - until January 12th.\u003cbr/\u003eIra Einhorn fled the United States shortly before his trial, but after 16 years in hiding, he was tracked down and arrested at his French home in June 1997.\u003cbr/\u003eHis lawyer was adamant that Einhorn would not receive new trial in the United States and therefore any extradition would be against the French constitution.\u003cbr/\u003eSOUNDBITE: (French)\u003cbr/\u003e\"Our position is clear that the legislative amendment is clearly unconstitutional therefore it can not be applied - therefore our position is clear. That this is not completely about the nuances of international law - that there is a person behind all of this and she is dead \u003cbr/\u003eSUPER CAPTION: Elisabeth Hall, Victim's sister\u003cbr/\u003eWhen Maddux, a former cheerleader from Tyler, Texas, disappeared, Einhorn said she had gone shopping and never returned.\u003cbr/\u003eBut 18 months later, neighbours told police of a stench coming from Einhorn's apartment, and Maddux's battered remains were found.\u003cbr/\u003eForensic experts said her skull had been smashed six times.\u003cbr/\u003eMaddux's family said they would consider returning to France in January and would continue to appeal if France rejects the extradition.\u003cbr/\u003eA French court refused to extradite Einhorn in December 1997, citing a French law that would have required a retrial if he was extradited.  \u003cbr/\u003ePennsylvania then passed a law promising Einhorn a retrial and he was re-arrested last September.\u003cbr/\u003eHis defence lawyers argue that, if extradited, Einhorn could face the death penalty, which is banned under French law. \u003cbr/\u003eThey also claim Pennsylvania courts might withdraw the pledge of a retrial.\u003cbr/\u003eIn a November interview on A-B-C television, Einhorn declared his innocence and claimed the C-I-A or K-G-B framed him after he uncovered classified mind-control experiments.\u003cbr/\u003eBordeaux, France - 1 December 1998\u003cbr/\u003e1.
