Tony looking out over river
France's homeless will be able to take the government to court for the right to housing under a proposed law that Prime Minister Dominique de Villepin said on Wednesday will soon be sent to lawmakers for approval.
The government has been forced to act by a successful campaign to highlight the plight of the homeless ahead of presidential elections this spring.
A non-governmental organisation (NGO) 'The Children of Don Quixote' have set up tents for the homeless in several French cities.
In recent weeks dozens of Parisians have taken up an invitation from the group, to spend a night with homeless people in the tent cities, trading the comfort of their apartments for the cold, noise and discomfort of a night on the street.
The enthusiasm on behalf of the homeless, and those housed in cheap hotels, appears to be spreading and a similar protest in Lyon has also had public support.
Tony makes himself comfortable in his new tent, provided by the non-governmental organisation (NGO) 'The Children of Don Quixote' as a part of a protest to highlight the problem of homelessness in France.
Tony is one of more than a dozen homeless people camped out in the centre of France's second city of Lyon.
The mass sleep-out in Place Bellecour, the city's upmarket main square is part of a campaign to place the plight of homeless right at the centre of the national political debate ahead of presidential elections in Spring 2007.
The demonstration aims to pressure the government to make firm commitments and act on the growing problem of homelessness in France.
The first tents in Lyon went up on Tuesday 2 January, following a successful campaign in Paris that began in December 2006.
The Lyon demonstration has begun with about 20 tents housing homeless people and a clutch of organisers.
The organisers hope those numbers will increase, as in Paris, where there are now some 250 similar temporary shelters.
Lyon's 'Children of Don Quixote' co-ordinator Marine Fourier says the homeless people taking part in the mass sleep-out come from a variety of backgrounds.
'The Children of Don Quixote' say that there is a real fear amongst French people of homelessness one day affecting them.
The NGO says that one in two people in France fear they could end up on the streets.
Under the rain, the shelters are certainly appreciated on the first night of the protest.
Tony who has lived on the streets for 22 of his 36-years is one of the veterans of the encampment.
He is cheerful as he zips up his tent, wishing everyone a good night.
With nightfall, quiet descends on the city-centre's newest camp site.
For the men and women who would generally be sleeping rough, this will be the first night in a long time where they will not only be dry and warm, but also feeling safe.
As the protest enters its second day sun shines down on the camp.
Another street veteran known as "Le Pere" (The Father) takes on coffee making duty - the area has now become a hive of activity.
Though there is some scepticism voiced by passers-by, most appear supportive of the demonstration.
The city-campers are relying on donations from local residents for food and drink.
One woman said that she planned to go home to make a large dish of couscous, an north African dish of wheat semolina which is very popular in France.
Another man came especially to sign the petition which demands that centres for homeless people are opened 24-hours a day with immediate effect.
Currently, most close in the early morning leaving people who are often in difficulty to fend for themselves.
The man says he is a veteran of various union-organised social justice demonstrations.
He thinks it is time for a demonstration on the issue of homelessness.
Tony says he ran away from home when he was 14-years old.
He says he ran away after his father was sent to prison and his mother would have nothing to do with him.
Though his grandparents looked after him for a while they decided to send him to a home.
As a teenager he was apprehensive of the types of people he would meet there - so he ran away.
Though he has two children, he never managed to settle down and has always ended up living on the streets.
He says his son is 4-years old but he has not seen him since he was a baby.
However he still keeps in contact with his teenage daughter.
Though sometimes haunted by thoughts of what could have been, he says it is his children who keep him going.
The 36-year old is a figurehead of sorts for those new to the streets.
He says it is logical to give them a helping hand, showing newcomers how to stay warm at night, how to find food and shelter.
Inseparable from his friends he shows where they all used to sleep.
Tony says that he is glad the 'Children of Don Quixote' have taken up their cause.
He says he lives off begging but also any odd job that comes his way.
People are helpful and he has sometimes been offered a place to sleep out at night - like a derelict barge moored on the banks of Lyon's Saone river.
But Tony says that being homeless means living in an often hostile environment and people object to him sleeping on the streets.
He says that people need to spend more than a couple of hours or even a couple of days living on the streets before they really understand the problems face by him and his friends.
Tony says that homeless people don't always beg and often take seasonal jobs to make ends meet.
Ultimately he says that he lives parallel to those whose routine is 'subway-work-sleep' but he believes he has a right to live his life the way he wants to.
The barge, that had provided them with a shelter is now slowly falling to pieces and Tony and his friends had to leave once the cold weather set in.
Though Tony is generally optimistic, not far beneath the surface is a strong sense of despair.
He openly admits he has a drinking problem, a heroin habit and that he has shown little respect for his body.
He's seen several of his friends die on the streets and says he doesn't think he will live very long and will be happy to reach his 37th birthday.
He recognises that his actions are self destructive, but that after more than twenty years on the streets he's become hardened to the knocks of life on the streets.
He does not blame anyone for his life. It is his way of life now.
The 'Children of Don Quixote' movement is already starting to show results and with a presidential election looming, the leading candidates have expressed their support for the cause.
On Wednesday Prime Minister Dominique de Villepin said that France's homeless will be able to take the government to court for the right to housing under a proposed law that will soon be sent to lawmakers for approval.
The NGO says the Lyon authorities have so far not objected to the demonstration and hopes they will be allowed to remain for the time being.
The organisers say they won't budge until the problem of homelessness is resolved nationwide once and for all.

<button aria-expanded='false' aria-label='Read more description'
