Various home videos and photos of Sean Goldman, David Goldman and Bruna Bianchi\u003cbr/\u003eBrazil's Supreme Court on Thursday delayed the return of a nine-year-old boy to his US father only hours after the man arrived from New Jersey in hopes of taking the boy home for Christmas.\u003cbr/\u003eThe court ruled that the child must stay in Brazil while it considers a request that his own testimony be heard in the case, which has dragged on for five years.\u003cbr/\u003eThe ruling means the boy will be in Brazil at least until February, according to a court spokesman.\u003cbr/\u003eDavid Goldman's lawyer Ricardo Zamariola confirmed the ruling means he will be unable to pick up his son Sean at the American Consulate in Rio on Friday, as a US federal appeals court had ruled on Wednesday.\u003cbr/\u003eSean's maternal grandmother was reportedly 'elated' at the decision. According to her, Sean, who has dual citizenship, has said he wants to remain in Brazil.\u003cbr/\u003eShortly before the stay was announced, Goldman, dressed in black, stepped off a 12-hour flight from New York into a scrum of reporters at Rio's international airport.\u003cbr/\u003eFacing the crowd of cameras and microphones, he quietly told reporters : \"I hope I can go home with my son,\" Goldman.\u003cbr/\u003eIn 2004, Goldman's wife, Bruna Bianchi, took Sean to her native Brazil. \u003cbr/\u003eGoldman says it was to be a two-week vacation, but she stayed and so did their son. She eventually obtained a Brazilian divorce from Goldman and\u003cbr/\u003eremarried.\u003cbr/\u003eGoldman was already seeking his son's return under international law on cross-border child abductions when his former wife died last year, giving birth to a daughter.\u003cbr/\u003eUS Congressman Chris Smith, who took on the case, in Brazil with Goldman, said he was deeply disappointed by the  latest court ruling and called on Brazil to send the boy back to the US based on international law.\u003cbr/\u003e\"Child abduction is a serious, serious crime and now, for over five years, David has been trying to get his son back,\" he said.\u003cbr/\u003eBefore the Supreme Court ruling, a lawyer for Sean's adoptive father, warned that additional appeals could block the transfer of Goldman's son and forecast that a final resolution would not come until at least the first half of 2010.\u003cbr/\u003ePrevious rulings favourable to Goldman, from Tinton Falls, New Jersey, have been scuttled by Brazilian courts. \u003cbr/\u003eGoldman and Sean were reunited in February for the first time since his son was taken to Brazil. They have not seen each other since June. \u003cbr/\u003eThe child, who has dual citizenship, has been shielded from speaking directly to the news media.\u003cbr/\u003eHis mother's death generated widespread interest in the case, which has been discussed this year by top-level diplomats in Washington and the Brazilian capital, Brasilia.
