Mid of Lubanga leaving\u003cbr/\u003eThe International Criminal Court ruled Friday that a trial of an alleged Congolese warlord should resume again after a three month suspension,  but reprimanded the\u003cbr/\u003eprosecutor for defying court orders.\u003cbr/\u003eThe court's president Sang-hyun Song supported harsh criticism by trial judges of prosecutor Luis Moreno Ocampo, but added that they should have sanctioned him rather than halting the trial in July.\u003cbr/\u003eThe decision clears the way for the resumption of Thomas Lubanga's trial on charges of using child soldiers in a brutal conflict in the eastern Democratic Republic of Congo in 2002-2003.\u003cbr/\u003eLubanga, dressed in a light blue robe and orange hat showed no emotion as Song read out the ruling. \u003cbr/\u003eProsecutors welcomed the decision, without addressing any of the court's criticisms. \u003cbr/\u003e\"Victims can rest assured that his trial will be continued, and that (Lubanga's) criminal responsibility will be decided by the judges at the conclusion of a fair trial,\" the prosecution said in a written statement.  \u003cbr/\u003eTrial judges halted the tribunal's first trial and ordered Lubanga be released in July after Moreno Ocampo refused to disclose the identity of an intermediary used by investigators to work with witnesses.\u003cbr/\u003eMoreno Ocampo had argued that his first duty was to protect the anonymity of the person, who was an intermediary used by investigators to work with witnesses and who could be at risk if his identity were disclosed.\u003cbr/\u003eWhile reversing the lower court's decision to end the trial, Song also rebuked Moreno Ocampo for flouting court orders.\u003cbr/\u003eSong said no court can function if the prosecutor can pick and choose which instructions from judges he obeys, and he rejected Moreno Ocampo's argument that prosecutor's obligations to protect witnesses and other people who work with them can override court orders.\u003cbr/\u003e\"The appeals chamber notes that Mr Lubanga Dyilo has argued that he should not be detained any longer, due to the inexcusable delay of the prosecutor, however the trial chamber did not make any finding that Mr Lubanga Dyilo was detained for an unreasonable period,\" Song said. \u003cbr/\u003eLubanga, 49, is charged with recruiting and sending child soldiers into deadly battles in eastern Congo's Ituri region. \u003cbr/\u003eHe denies the allegations and insists he was a politician and peacemaker, not a warlord.\u003cbr/\u003eHis trial has been troubled almost from its start in January 2009. \u003cbr/\u003eProsecutors tussled with judges over the admissibility of evidence gathered in confidence from UN personnel and non-government volunteers in the battlefield, who believed disclosure of their identities could jeopardise their lives or work.\u003cbr/\u003eThe court is the world's first permanent war crimes tribunal, designed to end impunity for the most serious perpetrators of atrocities in conflicts around the world.\u003cbr/\u003eIt started work in 2002 and so far has launched cases only in Africa. \u003cbr/\u003eIts highest profile indictment is against Sudanese President Omar al-Bashir, who is charged with genocide in the Darfur conflict. \u003cbr/\u003eAl-Bashir has vowed never to surrender to the court, and the court lacks
